1. Identity – This online planroom service is maintained by the Marquette Builders Exchange, hereinafter (“MBE”). This online planroom contains information about plans, bidders and other matters of interest to members of the Marquette Builders Exchange.
2. Agreement to be Bound – Use of these services constitutes agreement to abide by the rules and regulations of the MBE and of this online planroom, and may be promulgated from time to time, including acceptance of the terms and conditions set forth in this User Agreement.
3. Changes to User Agreement – MBE may change this User Agreement at any time, without notice, by posting such changes on this site. MBE reserves the right, for any reason, in its sole discretion, to terminate, change, suspend or discontinue any aspect of this online planroom, including, but not limited to, content, features or availability. By using this online planroom following any modifications to the terms and conditions of this User Agreement, you agree to be bound by any such modifications. MBE may also impose limits on certain features of this online planroom or restrict access to part or all of this online planroom without notice or penalty.
4. Disclaimer of Warranty – While the MBE expends efforts to accurately report all information contained on or in this service, neither the MBE nor this online planroom offers any warranty that any information contained in or a part of this online planroom is complete or accurate. A user’s best source of information are the actual plans and specification maintained by the design professional or the designated plan provider for a particular project. MBE expressly disclaims all warranties, including the warranties of merchantability and fitness for a particular purpose, in connection with the use or operation of this online planroom service.
5. Revisions and Errors – The MBE does not conduct an independent review of material available on this online planroom, thus available materials could contain and include technical, typographical or photographic errors. The MBE does not warrant or represent that any materials obtainable from this online planroom are accurate, complete or current. The MBE may make changes to materials available through this online planroom at any time without notice. The MBE does not make or have any commitment to update materials available through this online planroom.
6. Copyright and Use Restrictions – Documents obtained through the MBE Planroom may contain copyrighted materials owned by other third parties, including architects, engineers or others. These copyrighted materials are protected under U.S. Copyright law, Title 17, United States Code. Any reproduction, alteration or reuse of these materials without express written permission of the copyright owner is prohibited, with the exception that the MBE or an authorized member of the MBE may reproduce the documents for use solely in preparing bids or proposals pursuant to a request to bid on the project represented in the plans. Sharing of materials with non-members of the MBE is strictly prohibited and at the sole discretion of MBE, may be grounds for immediate termination of this Agreement.
7. Disclaimer of Liability – The MBE will not be liable for any losses, including lost data, information, profits or any other incidents of consequential damages that may be sustained or arise out of the use, operation or ability to use this service. In consideration for the privilege of using these products, users hereby release the MBE and its officers, employees, and web masters from any and all claims arising from the use of this system.
8. Limitations on Access – These services may be used only by employees of an MBE member or subscriber using the username and password that was provided by the MBE for that member or subscriber. The sharing of any username and/or password is strictly prohibited, and at the sole discretion of MBE, may be grounds for immediate termination of this Agreement. Use of this online planroom is for informational purposes only; copying is prohibited. MBE reserves the right to control or limit access to this service. Access may be denied at any time for any reason. Access will be denied to any individual or company who makes use of this online planroom service for improper purposes.
9. Subscriptions/Membership – The information available through the use of this online planroom is provided only for the members of the MBE. Membership subscriptions are based on and conditioned upon payment of fees determined by the MBE. Access to this online planroom will be terminated if a member’s account becomes past due.
10. Governing Law – Any claim relating to the use or maintenance of this online planroom is governed by the laws of the State of Michigan without regard to its conflict of law provision.
